General sales conditions


This information is given for the website “www.lefavole-wines.com” (Site) owned by the Società Le Favole di Evio e Angelo Cadorin s.s. with registered office in Via Ronche, 92 – 33077 Sacile (PN) IT, with VAT number 01551130931, hereinafter also referred to as Seller.
The sales on the Site are to be considered distance contracts according to the provisions of Chapter I, Title III of the Site (art. 45 and ss.) of Legislative Decree no. 206 of 6 September 2005 (Consumer Code) and referred to in Legislative Decree no. 70 of 9 April 2003, on electronic commerce.
The General Conditions of Sale apply to all sales made by the Seller on the Site.
Unless otherwise specified, the terms indicated are to be understood as working days, therefore excluding Saturday, Sunday and national holidays.
The General Conditions of Sale may be modified at any time at the discretion of the company, any changes and/ or new conditions will be in force from the moment of their publication on the Site. We therefore invite you to regularly access the area of the Site and to consult the most updated version of the same before making any purchase. The applicable General Conditions of Sale are those in force on the date of dispatch of the purchase order.
The submission of the purchase order constitutes acceptance of the General Conditions of Sale in force.


1. Products sold on this site

On this site are sold wines produced directly by the farm Società Le Favole di Evio e Angelo Cadorin s.s. At the time of order the wines are carefully packaged and then shipped by courier. The photos are indicative and the labels may vary from those presented on the site. The articles in the catalog, accompanied by an information page that illustrates the main features, are usually always available; in the event of unavailability of one or more of the products ordered you will be contacted promptly; You can cancel all or part of your order by receiving a refund, as soon as possible, as paid, or you can change the order by inserting other products available.
The purchase on the Site

may only be registered;
• is allowed both to Customers who cover the quality of consumers and to Customers who cover the quality of professionals. Pursuant to art. 3, 1st paragraph, lett. a) of the Consumer Code the quality of consumer the Customer is a natural person who acts for purposes unrelated to the entrepreneurial, commercial, professional or craft activity carried out; while pursuant to art. 3, paragraph I, lett. c) of the Consumer Code, the Customer is a professional, natural or legal person, who acts in the exercise of his business, commercial, craft or professional, or his intermediary.

The Seller reserves the right to refuse or suspend the execution of orders that come from:

• by a Customer with whom the Seller has a legal dispute
• by a Customer who has previously violated the General Conditions of Sale
• by a Customer who has issued false, incomplete or otherwise incorrect identification data or who has not sent the Seller the requested documents in a timely manner or who has sent invalid documents
• by Customers under the age of 18.
In accordance with Legislative Decree No. 70 of 9 April 2003 on electronic commerce, the Seller informs that:
• to purchase on the Site, the Customer must complete an order form in electronic format and send it to the Seller electronically, following the instructions that will appear from time to time on the Site
• once received the order form, the Seller will send to the Customer, to the e-mail address
indicated, the order confirmation containing specification:
of the products that make up the order and their main characteristics
of the total order price
of the Customer’s chosen means of payment
delivery charges
the (indicative) delivery time.


2. Shipments

Normally the ordered products are packaged, packed, and shipped within 1-2 working days of the completion of the purchase and delivered by the courier within 2-3 working days, except for the islands and areas with restricted transit. The terms are indicative and not mandatory. Unless expressly requested by the Customer, on Thursdays and Fridays no shipments are made to avoid that on the weekend (during which no deliveries are made) the product is replaced in the courier stores.
Except for orders with cash on delivery payment, the Seller will only ship the products ordered after final crediting to its bank account of the total amount owed by the Customer. The risk of loss or deterioration of the products, for reasons not attributable to the Seller, will be transferred to the Customer from the moment when the latter, or a third party designated and other than the carrier, materially takes possession of the same


3. Prices and taxes

The prices shown on the Site are inclusive of VAT and other excise duties and taxes, and net of shipping costs unless otherwise provided.
The Seller reserves the right to change the price of the products at any time and without notice, provided that the price charged will be that indicated on the Site at the time of placing the order and that any changes will not be taken into account (increasing or decreasing) after transmission.


4. Payments

The following payment methods are accepted:

a. Credit card, also via PayPal.
It is the recommended payment method for fast order processing and shipping of products.
The following credit cards are accepted: VISA, American Express, Cartasi, Nexi MasterCard, Maestro.

If the Customer wishes to use the PayPal system, he will be automatically redirected from the Seller’s website to the website www.paypal.it, where he will make the payment by Credit Card according to the procedure provided for therein and regulated, the terms and conditions established by PayPal.
The data entered on the PayPal website are processed directly by PayPal, without being transmitted or in any way shared with the Seller.
In case of termination of the purchase contract and in any other case of refund to be made to the Customer, the amount to be returned will be credited by the Seller exclusively to the Customer’s PayPal account.
Once the credit order has been placed on this account, the Seller cannot be held responsible for any delays or omissions in the credit of the refunded amount, to dispute which the Customer must contact directly and exclusively PayPal.

b. Bank transfer
In order to process an order for products purchased by bank transfer, the Customer must first send by e-mail (e-commerce@lefavole.com) the payment account issued by the bank.
The IBAN to be used for the transfer will be transmitted to the Customer at the time of the order.
The shipment of the products will take place only after the final crediting of the total amount due by the Customer in the Seller’s bank account.

c. Marking
With cash on delivery, the products ordered and the shipping costs are paid by the customer to the courier at the time of delivery.

The marking involves the application at the expense of the Customer of additional costs for the service. These costs are communicated to the Customer in the order confirmation.
The Seller reserves the right from time to time to accept or reject this payment method.


5. Right of withdrawal

If identifiable as a Consumer pursuant to Legislative Decree no. 206/05 (Consumer Code), the Customer will have the right to withdraw from the purchase contract, without the need to indicate reasons or provide explanations and without applying any penalty, within 14 calendar days from the date of receipt of the purchased products. To exercise this right, he should simply send to “Società Agricola Le Favole di Evio e Angelo Cadorin s.s., Via Ronche 92 – 33077 Sacile (PN)”, a written communication to this effect and, within the same period of 14 calendar days, also proceed with the return/ shipment of products purchased at the same address.
For an effective and valid exercise of the right of withdrawal, the packaging must reach the Seller’s address in perfect condition and the wine containers (bottles, flasks, carboys, glass or other material) must be unopened, intact and sealed as originally. The containers must also be accompanied by all accessories, such as capsules, labels and identification tags, attached to the product and not tampered with, packaging materials and, if any, leaflets, leaflets and any freebies. All suitable for its intended use and free of any signs of damage or dirt.
There are no prescriptions on the method to be used to make the return (direct delivery, mail, courier, etc.).
The costs necessary to return the products are borne by the customer, as well as the risk and responsibility for any damage / loss thereof during transport.
Where the product in respect of which the withdrawal has been exercised has suffered a reduction in value as a result of manipulation of the goods which is unsuitable or which is not necessary to preserve their nature and characteristics, the Seller reserves the right to reduce the amount of the refund by an amount equal to the decrease in value. The Seller shall notify the Seller of the circumstance and the consequent reduced refund amount within 5 days of receipt of the product.
As soon as the products returned by the Customer are received, the Seller will carry out the necessary checks and activate the procedures for the refund. The refund time will depend on the payment method used for the purchase. In any case, they will not exceed 14 days from receipt of the return.


6. Billing

In the payment form there is a flag “Request invoice”. Activating it will issue the invoice.
By entering data such as VAT and Unique Code, the Customer identifies himself as a professional (and not as a consumer) in relations with the Seller pursuant to Legislative Decree no. 206/05 (Consumer Code).


7. Shipments

Shipping costs calculated according to the destination will be charged to the Customer and explained in the order confirmation.
In limited periods of the year there are special offers and/or free shipping.
The delivery will be made during office hours, only on working days: we therefore suggest to enter a delivery address where there is someone who can pick up the goods.
In case of breakage of bottles (or other containers) of wine during transport, the Seller will send them again at his expense.


8. Guarantee

Purchases on the Site are subject to the legal guarantee provided by art. 1490 of the Civil Code.
Customers who have the quality of Consumers also enjoy the Legal Guarantee of Compliance as required by art. 128-135 of the Consumer Code, for which the Seller is liable to the Consumer for any lack of conformity of the product that occurs within two years of delivery.
The lack of conformity must be reported to the Seller, under penalty of forfeiture from the guarantee, within two months from the date on which it was discovered.
